Judge Samuel Alito Faces U.S. Senate Judiciary Committee Hearing on Nomination to the Supreme Court

You hear the name often recently but do you really understand the man and the potential influence his position holds? And what is with the Roe v Wade issue, is this the only way to really judge a judge?

For Judge Alito, The Roe v Wade question is the ultimate trip-up. If he answers yes, he will be asked to sign documents confirming his position, if he answers no, they (Dems) will attempt to have him disqualified on the basis of his answer. What can he do? This is a trick question that is almost impossible to correctly answer in the venue provided.

If justice is blind then why are our Supreme Court Judges subjected to questions that attempt to display any partisanship a person may be attempting to hide. If you suspect the man is not going to be fair then why not call him out on it and get the cards on the table. These questions about where an individual stands on Roe v Wade, Gay Rights, Immigration, they are all meant to really be disqualifiers. The question askers in most cases are the ones who should really be scrutinized.

I understand these are personal preferences but the judges are supposed to uphold the law, regardless of their personal preference. Therefore by subjecting nominees to continuous battering you are either telling me you don’t trust him, or you think he is a liar. Either way, do these questions really prove anything other than suspicion?

It is hoped that a Supreme Court Justice would rise above partisan politics.

The President has nominated Samuel Anthony Alito Jr. as a prospect for appointment to the Supreme Court justice. Judge Alito is currently a judge on the United States Court of Appeals for the Third Circuit. President George W. Bush has nominated him to the position of Associate Justice of the United States Supreme Court; he is expected to take the place of retiring Justice Sandra Day O’Connor.

Recently Senate Democrats have advised they expect to have a drawn-out confirmation hearing for Judge Alito, some have mentioned the dreaded ‘F’ word, a potential filibuster. Some Democrats feel that if Samuel Alito tries to duck or evade answers to their questions on abortion, presidential powers, or immigration, they will evoke the filibuster policy. Chuck Schumer stated, “If he continuously, given his previous record, refused to answer questions and hid behind ‘I can’t answer this because it might come before me,’ it would increase the chances of a filibuster.” Senator Schumer is a member of the Senate Judiciary Committee.

The Republicans have responded to the threat of a filibuster by stating that are ready to vote for Senate Majority Leader Bill Frists’ plan, this is a proposed plan to ban judicial filibusters.

  1. There are many other questions that were thrown at Alito today. Many on both sides feel he answered the questions well and feel he will be a good nominee for appointment which is there way of saying he most likely will be a Supreme Court Justice when all this is said and done.
