If found, the leakers could attempt to claim that the information was wrongfully classified, and thus they were allowed to divulge it. Executive Order 13292 covers secret national-security information. The order states that nothing can be classified so as to conceal violations of law, inefficiency, or administrative error. The individuals who leaked information to the Times could try to defer back to this order.
Senator Arlen Specter has asked for a hearing on the matters, he wants the hearing to occur in front of the Judiciary Committee. However, many feel the issue should be reviewed by the Intelligence Committee. Republicans say they welcome the hearings in either manner because it offers them a chance to clear the air on what is currently being discussed. They feel that approval by either committee will ad legitimacy to the program and quiet critics of the President.
Regardless of where the hearing take place, the main concern is that what is spoken of must stay classified to protect operatives, and operations, currently in place that may be only slightly related to this issue
The President and Vice President have recently been outspoken regarding the wiretaps, they feel the steps are legal and warranted for our countries protection. Many others differ on this subject; they feel the policy is an encroachment on their civil liberties. Regardless of who is right, or wrong, I hope that our country remains safe and our liberties remain in tact.
